The agreement
These Terms of Service ("Terms") are a contract between you and Axis Software, Inc. ("Axis") governing your access to and use of our website and application (the "Services"). By accessing or using the Services, you agree to these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.
Accounts
You must provide accurate information when creating an account and keep your credentials secure. You are responsible for activity that occurs under your account. Notify us promptly of any unauthorized use.
Acceptable use
You agree not to:
- Use the Services to violate any law or third-party rights.
- Send unlawful, harassing, or unsolicited messages, including SMS that violates applicable consent rules.
- Attempt to access, probe, or disrupt the Services or other users' data without authorization.
- Reverse engineer or resell the Services except as permitted by law.
SMS messaging consent
By providing your mobile number, you consent to receive SMS messages from Axis Software, Inc. related to property management services, including work order updates, maintenance notifications, and account communications. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help. See our Privacy Policy for details.
Your data
You retain all rights to the data you and your users submit ("Customer Data"). You grant Axis a limited license to host, process, and use Customer Data solely to provide and improve the Services and as described in our Privacy Policy. You are responsible for the accuracy and legality of Customer Data and for obtaining any necessary consents, including for messaging recipients.
Cipher AI
The Services include AI-assisted features ("Cipher") that generate summaries, drafts, and suggestions based on your account's data. AI output may be inaccurate or incomplete and should be reviewed before you act on it. You are responsible for decisions made using Cipher output. Cipher does not constitute legal, financial, or professional advice.
Fees & billing
Paid plans are billed per building on the cadence shown at purchase. Fees are non-refundable except where required by law. We may change pricing with notice; changes take effect at your next renewal. Late or failed payments may result in suspension.
Term & termination
These Terms apply while you use the Services. You may stop using the Services at any time. We may suspend or terminate access for breach of these Terms or to protect the Services. On termination, you may export your Customer Data for a reasonable period, after which we may delete it.
Warranties & disclaimers
The Services are provided "as is" and "as available." To the fullest extent permitted by law, Axis disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, Axis will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability arising out of or relating to the Services will not exceed the amounts you paid to Axis in the twelve months before the event giving rise to the claim.
